5 Kings Marketing (“we,” “us,” or “our”) operates the website 5kingsmarketing.com and provides digital marketing, SEO, AI marketing automation, lead generation, e-commerce development, and related consulting services (collectively, the “Services”). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our site, request a free SEO audit, submit a contact form, or otherwise engage with us.

By using the Services, you agree to the terms of this Privacy Policy. If you do not agree, please discontinue use of the Services.

1. Information We Collect

Personal Information You Provide

When you fill out a form, request a consultation, sign up for our newsletter, or otherwise interact with our Services, we may collect:

  • Name (first and last)
  • Business name and website URL
  • Email address
  • Phone number
  • Billing address (when entering a paid engagement)
  • Industry, monthly revenue range, and current marketing spend (used to qualify leads)
  • Free-form notes you choose to share in the message field

Information Collected Automatically

When you visit our site, we and our third-party providers automatically collect:

  • IP address, browser type, device type, operating system, screen resolution
  • Referring URL, exit URL, pages viewed, time on page, scroll depth, click paths
  • Approximate geographic location derived from IP (city, region, country)
  • Marketing attribution data (utm_source, utm_medium, utm_campaign) when present

2. How We Use Your Information

We use the information we collect to:

  • Respond to your inquiries and deliver the SEO audit or consultation you requested
  • Send transactional emails (proposal, contract, invoice, audit results) related to a service engagement
  • Send marketing communications about our services, case studies, and industry insights — only if you opted in or we have an existing business relationship
  • Improve site performance, content, and user experience through aggregated analytics
  • Detect and prevent fraud, spam, or abuse of our Services
  • Comply with legal obligations and respond to lawful requests from authorities

3. Cookies and Tracking Technologies

We use cookies, local storage, and similar technologies to operate and measure our site. The categories we use:

  1. Strictly necessary cookies — required for core site functionality (session, authentication, form submission). Cannot be disabled.
  2. Analytics cookies — Matomo (self-hosted at analytics.5kingsmarketing.com) provides first-party, cookieless-by-default analytics. Matomo is configured to anonymize the last octet of visitor IPs and to honor “Do Not Track” browser signals. No data is sent to Google, Facebook, or any third-party analytics provider.
  3. Marketing cookies — used to attribute conversions to a campaign and to suppress ads for users who have already converted. We do not run retargeting pixels from third-party ad networks on the public site.

You can clear or block cookies through your browser settings. Blocking strictly necessary cookies will prevent form submission from working.

4. Third-Party Services We Use

To deliver the Services, we share specific data with vetted vendors under written data-processing agreements:

  • Mautic (self-hosted marketing automation) — receives name, email, and form-message when you submit a contact or audit form. We use this to send follow-ups and our newsletter.
  • SuiteCRM (self-hosted customer relationship management) — receives qualified leads after a sales conversation, including phone, business name, and notes. Used for proposal generation and account management.
  • Google Search Console — accessed only after you grant explicit OAuth consent through the Agency Tracker dashboard. Used to pull search performance data for properties you authorize.
  • Hosting and infrastructure — the site is hosted on infrastructure provided by our managed hosting partner. All data is stored in U.S. data centers with TLS 1.3 in transit and AES-256 at rest.
  • Email delivery — outbound transactional and marketing email is sent through a U.S.-based transactional email provider in compliance with CAN-SPAM.

We do not sell, rent, or trade your personal information to data brokers or third-party advertisers.

5. Data Retention

We retain personal information only as long as needed for the purposes described in this policy or as required by law:

  • Contact-form submissions: 24 months from last interaction, unless you become a customer
  • Customer engagement records: 7 years after the engagement closes (tax and contract recordkeeping)
  • Analytics data (Matomo): aggregated, IP-anonymized; raw visit logs purged after 13 months
  • Marketing email unsubscribe list: retained indefinitely to honor your opt-out

6. Your Rights

Depending on your jurisdiction, you may have the right to:

  • Access the personal data we hold about you
  • Correct inaccurate or incomplete data
  • Request deletion of your data (subject to the retention rules above)
  • Opt out of marketing emails at any time via the unsubscribe link in any email we send, or by replying STOP
  • Request a portable copy of your data

To exercise any of these rights, email us at [email protected] from the address you originally submitted. We will respond within 30 days.

7. Children’s Privacy

Our Services are intended for business professionals aged 18 and over. We do not knowingly collect personal information from anyone under 18. If we learn we have collected such information, we will delete it.

8. Security

We use industry-standard safeguards to protect your information: TLS encryption in transit, encryption at rest, role-based access controls, audit logging, and annual third-party security reviews. No system is 100% secure, and we cannot guarantee absolute security.

9. International Transfers

We are a U.S.-based company. If you visit our site from outside the United States, you understand that your information will be transferred to, stored in, and processed in the United States. We rely on Standard Contractual Clauses (SCCs) with our subprocessors for any required cross-border data transfer.

10. Changes to This Policy

We may update this Privacy Policy from time to time. The “Last updated” date at the top reflects when changes were last made. Material changes will be announced via a banner on the site and, where appropriate, by email.
